Usage and log data

When you visit our website, we process usage and log data to display our site and ensure its stability and safety. In addition, we use the log data for statistical analysis as part of the operation of our website.

In the case of unlawful use of our website, the log data will allow detection of a possible breach or infringement, for example, in the event of a cyber-attack on our website. 4. YouTube videos

We have included YouTube videos on our website, which are stored at https://www.youtube.com/ and can be played directly from our website. The site operator is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA, and in Europe Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

We use the "extended privacy mode", in other words, data about you as a user will not be passed on to YouTube if you are not playing the videos. The data mentioned in the next paragraph will be transmitted to YouTube only when you play the videos. We have no influence over this data transfer.

When you visit the website, YouTube receives the information that you have accessed the corresponding subpage of our website. 5. How and on what legal basis do we process your data when you register for the Token Sale?

You can register for Nuco Development Tokens ("NCDTs") Token Sale on our website. To register, you must provide your e-mail address. We use the double opt-in process. Once you have registered for Token Sale, you will receive an email with a confirmation link. If you confirm your registration within the specified time, the data collected from you will be stored. Otherwise your data will be deleted automatically after the specified time has expired.
We also collect data so that we can fulfill our obligations to identify our customers before you can purchase NCDTs.
You must provide your surname and first name, date of birth, place of birth, nationality, residential address (street, house number, postcode, municipality, country of residence), e-mail address, telephone number and the serial number of your official ID containing a photograph. You must also upload a copy of your official identity document (front and back). In addition, a video ID procedure must be carried out in order to participate in the Token Sale.
We use Fractal Blockchain GmbH as the contract processor for customer identification and verification.
Furthermore, we process the data concerning the means of payment used by you (e.g. IBAN, wallet address) when paying for the NCDTs.
If you wish to retrieve your purchased NCDTs from our website, you must provide your wallet address (public key).
The legal basis for the data processing is the fulfilment of the contract or the implementation of pre-contractual measures pursuant to Art. 6 Para. 1 UAbs. 1 lit. b GDPR as well as, if applicable, the fulfilment of a legal obligation pursuant to Art. 6 Para. 1 UAbs. 1 lit. c GDPR.
During registration, we also store your IP address and the time of registration and confirmation in order to be able to prove your registration and clarify any misuse of your personal data. The legal basis for this is Art. 6 Para. 1 UAbs. 1 lit. f) GDPR.

6. Who receives my data?

We will only share your personal information if you have consented thereto, if it has a legal basis, or if it is necessary to enforce our rights. Your data will only be transferred to service providers if they comply with the relevant data protection requirements.

7. When will my data be deleted?

We will delete your data as soon as it is no longer needed for the purpose for which it was originally collected. For example, we will delete your usage data after your visit to our website if we are not allowed to process it for statistical purposes in anonymous or pseudonymized form as described above. For example, we delete your data from requests immediately after successful processing if we are not allowed to process it to inform you of new developments and events. Otherwise, we store your data even after fulfillment of the original collection purpose if we are obligated to do so for other reasons such as for archiving.

8. Is your data transmitted to a third country or international organization?

If we process data in a third country (in other words, outside the European Union (EU) or the European Economic Area (EEA)) or in the context of the use of third party services or the transfer or transmission of data to third parties, this will only happen to fulfill contractual (or pre-contractual) obligations, based on your consent, on the basis of a legal obligation, or based on our legitimate interests. Subject to legal or contractual approvals, we process the data in a third country only under the special conditions of Art. 44 et seq. GDPR. The processing is based on specific guarantees, such as the officially recognized level of privacy (for example, Privacy Shield for the US) or compliance with officially recognized special contractual obligations (“standard contractual clauses”).

9. What rights do you have regarding the processing of your data?

Regarding the protection of your personal data, you have the following rights:

  • the right to information in accordance with Art. 15 GDPR,
  • the right to correct and update your data in accordance with Art. 16 GDPR,
  • the right to have your data erased according to Art. 17 GDPR,
  • the right to restrict data processing in accordance with Art. 18 GDPR,
  • the right to data portability according to Art. 20 GDPR.

Your right to information and the erasure of data are subject to the restrictions of §§ 34 and 35 BDSG. In addition, you have a right of appeal to the data protection supervisory authority (article 77 GDPR in conjunction with section 19 BDSG).

10. Will we use your data for automated decision-making including profiling?

Data from visits to this website will not be used for automated decision-making including profiling according to Art. 22 GDPR.

11. Information about your right to object according to Article 21 GDPR

Data from visits to this website will not be used for automated decision-making including profiling according to Art. 22 GDPR.

Case-specific right of objection

You have the right to object to the processing of personal data concerning you at any time, for reasons arising out of your particular situation pursuant to Article 6 (1) e GDPR (Data Processing in the Public Interest) and Art. 6 (1) subparagraph 1 f GDPR (data processing based on a balance of interests).
